Larchmont Considers Changing Regulations for Gasoline Service Station Stores

Larchmont Mayor Sarah Bauer convened the June 22 Board of Trustees meeting, beginning with a letter from Kevin J. O’Brien, Esq., O’Brien Law P.C. to attorney Kevin E. Staudt, McCullough, Goldberger and Staudt, LLP, regarding Gasoline Service Station Convenience Stores.
“We have reviewed the proposed ordinance and agree with most of the design and ordinance considerations; however, I would like to highlight certain specifics that you may wish to consider changing. The following represent our considerations and recommendations:
1. Proposed ordinance limits service stations to RB Zoning District only. We suggest adding RC as our service station closest to Village Hall is located in the RC District.
2. The current proposal limits vehicular access to the State road only. We recommend permitting one curb cut on the side street, which would allow for easier on-site and off-site traffic circulation. The curb cut could limit or prohibit turns in this instance—left-hand turns into the residential neighborhood.
3. Limitation to 1,000 square feet net floor area. We suggest at least 2,000 square feet and would need to more clearly define net floor area. Usually, that excludes storage, utilities, restroom, office area and cashier area and includes only public accessible retail space. Most of the tenants’ convenience store locations range between 2,000 and 3,500 square feet gross floor area. Our current service station buildings in the Village have an area of 2,000 and 2,257 square feet respectively.
4. Exterior lighting. We agree with the limitation of lighting as it may abut neighboring residential properties, however adequate lighting should be provided at the curb cuts along the State roadway.
5. Prohibition against on-site food consumption. Operator should be permitted to have prepared foods for off-site.”
· Public Hearing for all interested persons to be heard in favor of or in opposition to the proposed renewal of the Verizon New York Inc. franchise for a period of 5 years.
· Resolution Authorizing the Village to Renew a Cable Franchise Agreement with Verizon New York, Inc. to operate a Cable System in the Village of Larchmont.
Police Chief Chris T. McNerney reported an illegal transfer of $1,500 at the CVS parking lot on May 19. Mabel Mejia was appointed as Probationary Police Officer.
McNerney also reported numerous thefts of scooters from the Train Station parking lot.
